General Terms and Conditions (GTC)
1. Scope of Application
These General Terms and Conditions apply to all services, offers, and contracts between Secret Visuals (hereinafter referred to as "Provider") and its customers in the version valid at the time of the order.
Deviating conditions of the customer do not apply unless explicitly agreed to in writing.
2. Services
The provider offers creative services, especially in the areas of:
Image editing and retouching
Design, branding, and visual concepts
Video editing, video production, and video creation
Content optimization for platforms and social media
Creative consulting, technical support, and related services
The specific scope of services results from the respective offer or individual agreement.
3. Free Sample Services
Free sample, demo, or test services serve to illustrate the working method of the provider.
Unless explicitly stated otherwise, all content created within the framework of the sample packs (e.g., image edits, video clips, teasers, visuals, or layouts) may be freely used, published, and processed further.
Excluded from this are logo designs.
Logo designs created within the framework of the sample packs are for conceptual depiction only and do not include usage rights.
Usage, reuse, or publication of logo designs is only permitted after a separate order and compensation for the corresponding usage rights.
Further usage, editing, or publication will occur solely after a separate, chargeable order.
4. Commissioning & Extensions
Change requests, extensions, or additional services that exceed the originally agreed scope require a separate order.
The costs incurred will be communicated to the customer transparently before implementation.
5. Usage Rights
For all paid services commissioned, the usage rights are individually agreed upon and transfer to the customer only after full payment of the agreed remuneration.
The regulations mentioned in point 3 apply to content created within the framework of the sample packs.
6. Customer Participation Obligations
The customer provides all content, information, and materials necessary for service delivery in a timely manner and assures that they have the necessary rights.
The provider assumes no liability for content provided by the customer.
7. Liability & Disclaimer of Success
The provider does not guarantee specific economic, algorithmic, or reach-related results.
Results may depend, in particular, on:
Platform guidelines
Algorithms
Audience behavior
External factors beyond the provider's influence
Liability is limited to intent and gross negligence, as far as legally permissible.
8. Discretion & Confidentiality
The provider commits to a discreet and confidential collaboration.
Customer names, contents, or projects will not be used as a reference unless there is explicit consent from the customer.
9. Rejection of Orders
The provider reserves the right to reject orders without stating reasons, particularly in the case of:
Legally questionable content
Violations of platform guidelines
Ethically problematic or criminal content
10. Access Restrictions / Age Requirement
The access to this website and to certain content is exclusively reserved for persons who have reached the age of 18.
By entering the website, the user confirms that they are of legal age and act independently. The provider assumes no liability for false age declarations or misuse of the website by minors.
11. Final Provisions
The law of the Federal Republic of Germany applies.
The place of jurisdiction is – as far as permissible – the registered office of the provider.
Should individual provisions be ineffective, the effectiveness of the remaining regulations shall remain unaffected.
